Steps in the Criminal Justice Process

If you’re facing felony charges in Kentucky, here’s a simple guide to the process your case will go through within the criminal justice system:

Step 1

Reporting the Crime

The process starts when the crime is reported to the police. This can happen either when law enforcement is called to the crime scene or when someone contacts the authorities to report the crime.

Step 2

Investigation

Once the crime is reported, the police conduct an investigation. They will question the victim and any relevant witnesses to gather important evidence.

Step 3

Filing a Complaint

A formal complaint is filed, either by the police or the victim. The complaint is then submitted in District Court with an affidavit, and either an arrest warrant or a summons to court is issued.

Step 4

Arraignment

Within 48 hours of your arrest, you will appear before the District Court for an arraignment. This is where the judge sets your bond, confirms your legal representation, and schedules the Preliminary Hearing.

Step 5

Preliminary Hearing

At this stage, the judge will decide if there is enough evidence to charge you with a crime. If there is probable cause, your case will move forward to the Grand Jury.

Step 6

Grand Jury

The Grand Jury reviews the case, hearing testimony from the prosecutor and a witness (often a police officer). They then decide if there is sufficient evidence to issue an indictment. If an indictment is issued, the case continues; if not, it is dismissed.

Step 7

Arraignment in Circuit Court

After an indictment, you will be arraigned in Circuit Court. During this hearing, you will be formally informed of the charges against you, and you will enter a plea of not guilty. Your attorney will also address the bond issue with the judge, and a date for a future hearing or trial will be set.

Step 8

Pretrial Conference

In the pretrial conferences, your defense lawyer, the prosecutor, and the judge discuss how the case may be resolved. Several pretrial conferences may take place before the case proceeds to trial.

Step 9

Change of Plea

You may decide, with your attorney’s advice, to accept a plea deal instead of going to trial. If an agreement is reached, you will formally change your plea to “guilty.” If no deal is made, the case moves forward to trial.

Step 10

Trial

At trial, the prosecutor presents evidence against you, and your defense lawyer presents your case. The trial may be conducted by a judge (bench trial) or a jury (jury trial). To convict you, the prosecutor must prove your guilt beyond a reasonable doubt.

Step 11

Sentencing

If convicted, the judge will set a sentencing date. Before sentencing, a “pre-sentence investigation” will be done to assess your history and potential for rehabilitation. The victim may also make a statement. The judge will then issue a sentence according to the law.

Step 12

Appeal

If convicted, you have the right to appeal within 30 days. An appeal addresses any errors made during the trial and is based on the trial record, not new testimony
